Another food company faces potential products liability claims

In the 21st century, instances of food contamination should be rare. Sadly, it appears as though the media here in Pennsylvania and across the country relays news of food recalls due to some sort of contamination more often than seems reasonable. In fact, yet another food company could face products liability claims in the wake of a recall of its products.

According to the U.S. Department of Agriculture, the recall was issued due to the possibility that the affected products could contain foreign matter. Several of the products manufactured by Overhill Farms, Inc. may contain bone fragments. Around 54,630 pounds of the company's chicken bite products are the subject of the recall.

The USDA categorized the recall as "Class I," which means that the risk to consumers' health is high. Specifically, a Class I recall warns the public that the identified product could cause serious injuries or death. This is why consumers who purchase the products made by this California company are urged to stop consuming them and throw them away immediately. The products could also be returned to the establishment where they were purchased. The recall notice indicates that the USDA is not aware of any adverse health consequences from the products that are subject to the recall.

However, that could easily change. Grocery stores and other retailers who sell the products may get them off the shelves, but getting the news to Pennsylvania consumers could come too late. Anyone who believes that a recalled product caused them harm may want to consider filing a products liability claim against the appropriate parties. These cases can be complex, so securing the advice and assistance of legal counsel may help improve the chances of receiving restitution for the damages caused.
