Customer Claims Tainted CVS Eye Drops Caused Injury

As consumers, we expect the products on the shelves of stores to be safe.  We expect the manufacturers of the products we use to inspect and test the products before they reach the store shelves to ensure that they will not cause injury or illness.  When safety standards are overlooked personal injury can result from defective products

A CVS customer is claiming that this is precisely what happened when he purchased CVS brand eye drops earlier this year.  The customer purchased a box of the store brand eye drops and used the drops in accordance with the instructions on the box.  The customer claimed that upon applying the eye drops he experience intense pain and burning in his eyes.  He claims that the drops smelled like a chemical similar to bleach.  To date, he still suffers from redness, pain, and puss in his eyes, all of which he claims stems from the use of the CVS eye drops.

The customer alleges that the box and seal were not tampered with, accordingly it appears that the product was defective upon being manufactured and boxed.  The customer brought the suit against CVS and the manufacturer under the claims of gross negligence, breach of warranty, and strict liability.

The case is still in the early stages, should the customer be able to prove that the eye drops were defectively manufactured with a chemcial which caused the injury to his eye, then he may be able to recover in his case.  This will be an interesting case to see develop.
